COLUMBUS, Ohio - An Ohio appellate panel has reversed summary judgment awarded to an employer accused of failing to protect workers from exposure to insulation dust. Conley v. Faurecia Exhaust Systems Inc., et al., No. 2009 CA 26 (Ohio Ct. App., Miami Cty.).
The Court of Appeals for Miami County issued the opinion on May 28, reinstating the claims by Willard S. Conley Jr. against his employer, R&D Machine Inc., after finding that the lower court erred in barring a supporitng affidavit by the plaintiff worker's medical expert.
