INDIANAPOLIS - A state appeals court has affirmed dismissal of a workers' compensation claim brought by a woman who allegedly developed silicosis while working as a shipping clerk for a company that made silicone-based medical products. Ostrowski v. Accusil Inc., No. 93A02-0909-EX-863 (Ind. Ct. App.).
The Indiana Court of Appeals held March 29 that Twyla Ostrowski failed to show that a workers' compensation board erred when it ruled that her claim was barred by the statute of limitations, and that it was devoid of any evidence that she suffered from an occupational disease.
