Judge Denies Motion to Compel Data on MSA Dustfoe Respirator

ST. LOUIS - A federal judge in Missouri has denied a motion to compel discovery responses from Mine Safety Appliances concerning testing data and quality control information related to the company's Dustfoe 66 respirator. Savage v. 3M Co., et al., No. 08-1162 (E.D. Mo.).
Judge Charles A. Shaw of the U.S. District Court for the Eastern District of Missouri denied the motion without prejudice Dec. 18, after determining there was no evidence the parties made any effort to resolve the issue prior to bringing the motion.
