Specialty Sand Disputes Jurisdiction in Appeal of Miss. Silica Ruling

JACKSON, Miss. -- A sand company has appealed an order denying its motion to dismiss a Mississippi silica suit that was brought on behalf of a sandblaster allegedly exposed to the company's product in Louisiana and Texas. Specialty Sand Co. v. Birmingham, No. (Miss. Sup. Ct.).
In a petition for interlocutory appeal filed Dec. 18 in Mississippi's Supreme Court, Specialty Sand Co. says it has no ties to Mississippi and cannot be subject to personal jurisdiction in the state, despite evidence offered by the plaintiff showing that Specialty Sand sent invoices to a company headquartered in Mississippi.
