Plaintiff in May MDL Trial Withdraws Acting-in-Concert Claim

CLEVELAND - The plaintiff in a trial scheduled in federal MDL court in May has withdrawn two counts alleging joint wrongdoing by members of welding trade organizations. Mann v. Airco/BOC Group Inc., et al., No. 1:06cv17288 [MDL No. 1535] (N.D. Ohio).

Plaintiff David Mann filed the notice of dismissal of two counts on Feb. 17, and U.S. District Judge David D. Dowd Jr., granted the motion in an order signed on Feb. 22.
