CLEVELAND - The sole remaining defendant in a scheduled March welding fume trial has moved to exclude a PowerPoint display linked to another manufacturer and also wants the trial court to exclude emails and other items it says are irrelevant or prejudicial (Arroyo v. Lincoln Electric Co., et al., No. 1:08-wf-17980 [In re: Welding Fume Product Liability Litigation, MDL No. 1535] (N.D. Ohio).
Plaintiff Ruben Arroyo, meanwhile, filed an omnibus motion on Jan. 26 to exclude evidence it considers "irrelevant, unduly prejudicial" or "unscientific."
