Texas Workers' Comp Insurer Moves to Intervene in MDL Case

CLEVELAND - An insurer that says it provided workers' compensation benefits to a plaintiff in the federal welding products MDL has moved to intervene to recover the sums paid, plus costs and attorneys fees. Arroyo v. Lincoln Electric Co., et al., No. 1:08-wf-17980 [In re: Welding Fume Products Liability Litigation, MDL No. 1535] (N.D. Ohio).

Ace American Insurance Co. filed the motion to intervene in the case filed by Ruben Arroyo, which is scheduled for trial in March, on Nov. 19.

Ace says it was the insurer for Arroyo's employer, Trinity Industries, and has paid benefits based on the same …
