EVANSVILLE, Ind. - A federal magistrate judge has ordered national guardsman and others alleging injury from exposure to hexavalent chromium to disclose test results supporting their claims or provide expert testimony supporting causation. McManaway, et al. v. KBR Inc., et al., No. 3:08-cv-186-RLY-WGH (S.D. Ind.).
Magistrate Judge William G. Hussmann Jr. of the U.S. District Court for the Southern District of Indiana cautioned in his Nov. 20 order that defendants should not look at his Lone Pine ruling as the equivalent of a means of bypassing procedural rules on dismissal or summary judgment.
