PHILADEPHIA - One of the last two silica cases pending in Philadelphia's Mass Tort Program has settled after defendants filed a motion for summary judgment claiming that sand at the plaintiff's work site could not have been supplied by them. Parker v. New Jersey Silica Sand Co. Inc., et al., No. 0307003947 (Pa. Comm. Pls., Philadelphia Cty.).
According to sources, plaintiff Michael Parker and defendants New Jersey Silica Sand, Warner Co. and Waste Management of Pennsylvania Inc. reached an agreement in Philadelphia Common Pleas Court in November that disposed of Parker's case.
