Film Company Owed No Duty to Employee's Spouse, Court Affirms

LOS ANGELES - A California appellate court has denied a petition to reinstate a plaintiff's claim that her husband's employer owed her a duty a duty of care and is liable for her secondary exposure to toxic chemicals. Oddone v. Superior Court of Los Angeles County, No. B213784 (Calif. Ct. App., 2nd Dist.).

The California Second District Court of Appeal held on Nov. 24 that the Los Angeles Superior Court did not err in sustaining Technicolor Inc.'s demurrer to a cause of action asserting a claim on plaintiff Geraldine Oddone's own behalf, rather than on behalf of her husband's estate.
