OAKLAND, Calif. - A California judge is considering an award summary judgment to a silica defendant based on lack of product identification after testimony from the plaintiff's co-worker indicated that the company's product was used in the vicinity of where the plaintiff worked. Crenshaw v. Lone Star Industries Inc., et al., No. RG-05-210497 (Calif. Super. Ct., Alameda Cty.).
