CINCINNATI - An Ohio appellate court has affirmed summary judgment for two suppliers of diacetyl accused of failing to warn its customers' employees of the risks of exposure. Doane, et al. v. Givaudan Flavors Corp., et al., No. C080928 (Ohio 1st App. Dist.).
The First Appellate District said in its Sept. 25 opinion that summary judgment in favor of the two suppliers was warranted on statute-of-limitations and sophisticated-user grounds.
