Cooley Plaintiffs Move to Exclude 'Untimely' Defense Testimony

CLEVELAND - Plaintiffs in an upcoming welding fumes trial in federal court have moved to exclude testimony by three defense experts that they say will be based on recent opinions offered on manganese exposure limits. Cooley v. Lincoln Electric Co., No. 05-CV-17734 [MDL Docket No. 1535] (N.D. Ohio).
Those opinions were sent by defense experts Fred Boelter, Dr. Jeffrey Brent and Dr. Paul Lees-Haley to the American Conference of Governmental Industrial Hygienists in July but were not timely disclosed, plaintiffs argued in their Aug. 5 motion.
