Boeing Workers Denied Class Certification for Beryllium Exposure

LOS ANGELES - A California appellate court has affirmed a trial court ruling denying class certification to current and former Boeing employees who are suing over alleged exposure to impermissible levels of beryllium. Marin v. Brush Wellman Inc., B208202 (Calif. Ct. App., 2nd Dist.).

The Second Appellate District ruled on Aug. 24 that the plaintiffs failed to show that the trial court erred in concluding that individual issues would predominate over class issues.

Plaintiffs allege that Brush Wellman, a Boeing Contractor knowingly misrepresented that two micrograms was the permissible limit for beryllium exposure, while the true limit is one microgram. …
