Court Affirms Exclusion of Expert but Reverses Summary Judgment

NEW ORLEANS - A Louisiana appellate court has ruled that a trial court considering claims of injury from pesticide exposure did not err in excluding causation testimony by plaintiff's chosen toxicologist, but should not have granted summary judgment to the pesticide manufacturer. Versluis v. Gulf Coast Transit Co., et al., No. 2008-CA-0729 (La. Ct. App., 4th Cir.).

The Fourth Circuit Court of Appeal reversed summary judgment on July 29, saying that John Versluis may still prove that symptoms he suffered as a seaman on board a cargo ship were caused by exposure to aluminum phosphine gas, as he alleges.
