COLUMBUS, Ohio - An Ohio appellate panel has affirmed summary judgment for the state's Department of Transportation, which was accused of failing to enforce safety regulations that would have prevented a bridge painter from contracting lead poisoning. Krystalis, et al. v. The Ohio Department of Transportation, No. 09AP-112 (Ohio Ct. App., 10th Dist.).
The 10th District Court of Appeals ruled on July 16 that Theodore Krystalis failed to show that the state agency owed a duty of care to an employee of an independent contractor.
