Parties Agree to Abandon Appeal of Ruling on 'Plaintiff-Less' Case

JACKSON, Miss. - The Mississippi Supreme Court has agreed to dismiss a petition for interlocutory appeal in which several defendants asked that the court review a ruling that allowed a wrongful death silica case to proceed without a plaintiff. Pangborn v. Any Parties In Interest 1-30 on Behalf of All Wrongful Death Beneficiaries of Barber Luster, Deceased, No. 2009-M-00494-SCT (Miss. Sup. Ct.).
In an order issued June 23, the high court granted a joint motion to dismiss the appeal. Costs were taxed to the petitioner defendants. The order comes just three months after the Supreme Court said it would hear …
