CLEVELAND - Defendants and the plaintiff in a welding products trial scheduled to begin in September have moved to exclude or limit testimony by numerous experts scheduled to testify in the next federal MDL trial. Cooley v. Lincoln Electric Co., No. 1:05-CV-17734 [MDL No. 1535] (N.D. Ohio).
Defendants, in particular, call most of the opinions by experts for Curtis Cooley "unreliable" under the federal rules of evidence and Daubert v. Merrrell Dow Pharmaceuticals Inc. (509 U.S. 579 [1993]).
