Silica Plaintiff Seeks Delay Ahead of Anticipated Borg-Warner Showdown

HOUSTON - A plaintiff in the Texas Silica MDL has requested additional time to respond to a motion for summary judgment in hopes that the court will first determine whether the causation standard articulated in Borg-Warner Corp. v. Flores applies to silica litigation. Johnny Youngblood, et al. v. Falcon Building Products Inc., et al., No. 2005-79609 (Texas Dist. Ct., Harris Cty.).
