CLEVELAND - A Missouri pro se plaintiff who objected to a transfer to the federal multi-district litigation docket will nevertheless have to litigate her claims in the U.S. District Court for the Northern District of Ohio after the Judicial Panel on Multidistrict litigation finalized its transfer order. Emerson v. Lincoln Electric Holdings Inc., No. 5:09-6004 (W.D. Mo.).
The Judicial Panel said in its June 8 transfer order that while the plaintiff argued that discovery in her case will differ from other cases in the MDL, transfer has the "salutary effect" of allowing a single judge to consider all pretrial matters …
