MDL Court Amends Discovery Order to Allow for Pro Se Plaintiffs

CLEVELAND - Judge Kathleen M. O'Malley has amended a case management order to allow plaintiffs whose counsel have withdrawn after medical records discovery to proceed pro se. In re: Welding Fume Products Liability Litigation, No. 1:03-CV-17000 [MDL Docket No. 1535] (N.D. Ohio).

It is unknown how many plaintiffs have expressed a wish to proceed on their own, but the judge said in her July 7 order that the court's May 4 procedural order did not address the possibility.

Under the new order, plaintiffs will have 60 days after their counsel withdraws to either obtain new counsel or notify the court …
