Ohio Supreme Court Declines to Hear Failure-to-Warn Challenge

COLUMBUS, Ohio - The Ohio Supreme Court has denied a petition by welding consumable manufacturers to hear an interlocutory appeal of a ruling allowing a plaintiff to pursue failure-to-warn claims. Boyd v. Lincoln Electric Co., et al., No. 09-0376 (Ohio Sup. Ct.).

The Supreme Court entered an order declining jurisdiction, without explanation, on June 3.

In November, the Cuyahoga County Court of Appeals reversed a trial court and reinstated failure-to-warn claims by Joseph Boyd against Lincoln Electric Co. and other welding product manufacturers. Boyd, et al. v. Lincoln Electric Co., et al., No. 90315 (Ohio Ct. App., 8th Dist.)(See …
