Insurers Remove Welding Fumes Coverage Case to Federal Court

FLORENCE, S.C. - Insurers named in a coverage lawsuit filed by The ESAB Group Inc., a defendant in thousands of welding fume personal injury cases, have removed the action from state to federal court, citing diversity jurisdiction. ESAB Group Inc. v. Arrowood Indemnity Co., et al., No. 4:09-cv-01701-TLW (D. S.C.).
The case was removed on June 25 to the U.S. District Court for the District of South Carolina.
ESAB originally filed the lawsuit on March 29 in the Florence County (S.C.) Court of Common Pleas (No. 2009-CP-21-561) against Arrowood Indemnity Co., Liberty Mutual Insurance Co., Trygg-Hansa Forsakrings AB, Zurich …
