CLEVELAND - U.S. District Judge Kathleen M. O'Malley has dismissed the case of Joe E. Ousley with prejudice after Ousley's counsel notified the court that they wished to withdraw the case rather than take it to trial as scheduled on Jan. 25. Ousley v. Lincoln Electric Co., et al., No. 1:04-cv-17327 [In re: Welding Fume Products Liability Litigation, MDL Docket No. 1535 (No. 1:03-CV-17000)] (N.D. Ohio).
Judge O'Malley has replaced Ousley with another case, Ray v. Lincoln Electric Co. (No. 04-CV-18252) in the trial schedule.
Ousley contended that he suffered permanent neurological injuries from exposure to defendants' welding products.
