ASHTABULA, Ohio - An Ohio appellate court has affirmed summary judgment for a pigment manufacturer in an intentional tort case, saying the plaintiff worker failed to show that his employer's conduct was the proximate cause of his injury. Helfinstine v. Plasticolor, No. 2008-A-0065 (Ohio Ct. App., 11th Dist.).
The May 22 opinion by Ohio's 11th Appellate District was opposed by one dissenting judge.
Steve C. Helfinstine sued his employer, Plasticolor, alleging that his foot was injured when it came into contact with a liquid inhibitor containing P-Bezoquinine, Styrene and M. Pyrol.
