CHICAGO - The 7th Circuit U.S. Court of Appeals has affirmed dismissal of a workplace suit against CITGO Petroleum Corp., saying the trial court applied the proper standard in excluding the only causation testimony supporting plaintiffs' hydrogen sulfide exposure claims. Lewis, et al. v. CITGO Petroleum Corp., No. 08-1483 (7th Cir.).
The Circuit Court said in its April 6 opinion affirming summary judgment for CITGO that plaintiffs Michael Lewis and Tammy Livingston failed to counter CITGO's challenges to their experts' qualifications and/or methodologies.
