Ind. Court Finds Appeal Over Disputed Workplace Search Warrant Premature

INDIANAPOLIS — The Indiana Court of Appeals has dismissed a flavorings company’s legal challenge to a search warrant sought by occupational safety officials, saying that because the search has already been undertaken, the company must pursue any admissibility challenge through administrative channels first. Sensient Flavors LLC v. Indiana Occupational Safety and Health Administration, No. 49A02-1109-MC-844 (Ind. Ct. App.).
The court acknowledged in its June 26 order that it was denying Sensient Flavorings LLC timely review of the constitutional issues raised, but said the issue “is merely delayed until it becomes necessary to address this issue.”
