HATTIESBURG, Miss. - A Mississippi plaintiff has asked a trial court to reconsider its decision to stay her case pending the outcome of a state Supreme Court ruling, which she says will not dispose of the issue of whether her wrongful death claim was timely filed. Owens v. Pangborn Corp., et al., No. CI07-0108 (Miss. Cir. Ct., Forrest Cty.).
Sarah Owens says in a brief filed Feb. 20 in Forrest County Circuit Court that the stay should not have been entered because the defendants waived the statute of limitations defense they now rely on to seek dismissal of the case.
