CLEVELAND - Defendants in the federal Welding Fume Products Liability Litigation, given the opportunity to pick the next bellwether case, have chosen a Kentucky case for trial in January. Ousley v. Lincoln Electric Co., et al., No. 1:04-cv-17327-KMO [MDL Docket No. 1535] (N.D. Ohio).
Judge Kathleen M. O'Malley of the U.S. District Court for the Northern District of Ohio, who presides over the MDL, announced the pick in an order issued on Feb. 17.
Trial in Ousley v. Lincoln Electric Co. will begin on Jan. 25, following the next scheduled bellwether trial, Cooley v. Lincoln Electric Co. (No. 05-CV-17734), which …
