CLEVELAND - Judge Kathleen M. O'Malley has granted an unopposed motion to dismiss a complaint seeking medical monitoring for Louisiana welders. McCairo v. Lincoln Electric Co., et al., No. 1:05-CV-17727 [In re: Welding Fume Products Liability, No. 1:03-CV-17000; MDL Docket No. 1535] (N.D. Ohio).

Judge O'Malley, who presides over the federal multi-district litigation, granted the motion to dismiss the Louisiana case without written order on Jan. 14.

Defendants moved on Nov. 17 to dismiss Compton McCairo's amended complaint seeking medical monitoring for Louisiana welders, arguing that it failed to state a viable claim because Louisiana doesn't allow for medical monitoring …
