OAKLAND, Calif. - A mask maker and respirator manufacturer have moved separately for summary judgment in a silica case, arguing that the plaintiff failed to sufficiently identify their products as a cause of his silica-related injury. Brown v. Lone Star Industries Inc., et al., No. RG05-210447 (Calif. Super. Ct., Alameda Cty.).
In motions filed in March, Bacou-Dalloz and Mine Safety Appliances Co. contend that they should be dismissed from the Alamada County Superior Court case because plaintiff Chester Brown's identification of their products falls short of creating fact issues.
