Ohio Appeals Court Won't Reconsider Its Reinstatement of Warning Claims

CLEVELAND - An Ohio appellate court has denied a motion by defendant-appellee Deloro Stellite to reconsider its Nov. 26 ruling reinstating failure-to-warn claims by Ohio plaintiff Joseph Boyd. Boyd, et al. v. Lincoln Electric Co., et al., No. 90315 (Ohio Ct. App., 8th Dist.).
The court entered an order denying the motion on Jan. 9.
In its earlier ruling, the court concluded that Boyd raised sufficient questions of fact to allow trial on those warning claims, but it affirmed summary judgment on his aiding and abetting and express warranty claims (See HarrisMartin's Litigation Watch: Welding Fumes, Dec. 2008).
