DES MOINES, Iowa - A federal judge has denied defense motions in limine to exclude testimony by plaintiffs' medical experts on links between respiratory illnesses and workplace inhalation of diacetyl in artificial butter flavorings. <i.Kuiper v. Givaudan Inc., No. C06-4009-MWB (N.D. Iowa).
Judge Mark W. Bennett of the U.S. District Court for the Northern District of Iowa said in his Feb. 6 opinion, however, that he would consider limiting trial testimony that he found cumulative, or outside the witness's expertise.
