CLARKSBURG, W.Va. -- Dr. Ray Harron, who has been accused by asbestos defendant CSX Transportation Inc. of issuing fraudulent diagnoses, has filed a motion to dismiss the deception claim asserted against him, arguing that the federal court in which the claim was filed does not have subject matter jurisdiction. CSN Transportation Inc. v. Robert V. Gilkison, et al., No. 05-202 (N.D. W.Va.).
