JACKSON, Miss. - A Mississippi plaintiff has indicated she will appeal a ruling that prevented her from adding chemical defendants to a silica claim because she waited too long after filing her original complaint to do so. Miller v. American Optical Co., No. 2008-TS-02148 (Miss. Sup. Ct.).

Geraldstine Miller filed a notice of appeal Dec. 23 in Mississippi Supreme Court, challenging a trial judge's finding that the amended allegations against the new parties do not relate back to claims against 159 silica defendants named in the first suit.
