Attorney General May Intervene in Silica Case, But Not As Real Party

HOUSTON - The Texas Attorney General's office may intervene in a constitutional challenge to the state's silica medical criteria law, but must participate as an amici in the proceedings, a source told HarrisMartin Publishing. In Re: Texas State Silica Products Liability Litigation, No. 2004-70000 (Texas Dist. Ct., Harris Cty.).
According to the source, representatives with the attorney general's office and plaintiffs in the litigation reached the agreement prior to a hearing in Harris County District Court on the AG's motion to intervene.
