LOS ANGELES - Plaintiffs have moved to certify a class of all individuals and entities in California who paid for Vioxx prescriptions while the drug was on the market, claiming that Merck & Co. Inc. misrepresented the drug's safety and efficacy and caused plaintiffs economic harm. Vioxx® Cases, JCCP No. 4247 (Calif. Super. Ct., Los Angeles Cty.).
In a July 27 motion filed in the Los Angeles County Superior Court, the plaintiffs seek class certification for alleged violations of the Unfair Competition Law (UCL), the False Advertising Law (FAL), the Consumer Legal Remedies Act (CLRA) and for unjust enrichment.
