NEW ORLEANS - The FDA's approval of prescription drugs neither expressly nor impliedly preempts state-law claims that the drugs' manufacturers failed to provide adequate warnings of potential risks, the judge overseeing the federal Vioxx MDL has ruled in denying Merck & Co.
