Court Dismisses Vioxx Plaintiff's Skin Rash Claim for Failure to Prosecute

HUNTSVILLE, Ala. - A small claims court has dismissed for lack of prosecution an Alabama man's claims that Vioxx caused him to develop a skin rash, sources told HarrisMartin. Rollins v. Merck & Co. Inc., No. SM20063356 (Ala. Dist. Ct., Madison Cty, Small Claims Div.).
Henry Rollins' case against Merck & Co. Inc. was scheduled for trial on April 10 before Judge Dennis E. O'Dell in the Small Claims Division of Alabama's District Court for Madison County, but the plaintiff failed to appear, sources said.
