MDL Judge Denies Motion to Reconsider Statute of Limitations Ruling

NEW ORLEANS - For the reasons stated in the federal Vioxx MDL court's original order, the judge overseeing the MDL has denied Merck & Co. Inc.'s motion for reconsideration of the court's refusal to summarily determine statute of limitations issues. In Re: Vioxx Products Liability Litigation, MDL No. 1657 (E.D. La.).

Judge Eldon E. Fallon of the U.S. District Court for the Eastern District of Louisiana said in the instant April 9 order that in seeking reconsideration, Merck merely re-urged its arguments in support of its motion for summary judgment and contended that the court erred in denying the motion.
