NEW ORLEANS - Merck & Co. Inc. has asserted that a New Jersey appellate court's recent decision to reverse dismissal of a putative Vioxx medical monitoring class action does not undermine the company's arguments in the federal MDL that uninjured Vioxx plaintiffs may not sustain medical monitoring claims under state law.
