NEW ORLEANS - A Tennessee man who failed in December to persuade a federal Louisiana jury that Merck & Co. Inc. did not adequately warn about the potential cardiovascular risks associated with Vioxx has moved for a new trial. In Re: Vioxx Products Liability Litigation, MDL No. 1657 (E.D. La.).

Anthony Wayne Dedrick, who lost the fifth federal Vioxx trial on Dec. 13, filed the motion for a new trial on Jan. 4 under seal in the U.S. District Court for the Eastern District of Louisiana.
