Texas Woman Drops Vioxx Lawsuit Weeks Before November Trial




HOUSTON - A Texas woman who blamed Vioxx for her heart attack has dropped her claims against Merck & Co. Inc. two weeks before her trial was to begin in state court, sources told HarrisMartin. Rigby v. Merck & Co. Inc., No. 2005-31016 (Texas 157th Dist. Ct., Harris Cty.).

According to sources, counsel for plaintiff Sharon D. Rigby announced on Oct. 23 before a pretrial conference that the plaintiff had agreed to voluntarily dismiss her lawsuit against the manufacturer. Ribgy's case was scheduled to go to trial Nov. 8 in the 157th District Court for Harris County.
