NEW ORLEANS - The fourth plaintiff scheduled for trial in the federal Vioxx MDL recently moved for an order from the court compelling Merck & Co. Inc. to produce certain discovery-related documents for plaintiff's final depositions and October trial date in New Orleans. In Re: Vioxx Products Liability Litigation, MDL No. 1657 (E.D. La.).

Utah resident Charles Laron Mason filed the motion July 31 in the U.S. District Court for the Eastern District of Louisiana, stating that Merck has either failed to produce requested documents or has not offered adequate guidance as to their location.
