SAN FRANCISCO - Defendants in the federal Bextra/Celebrex MDL have moved to dismiss the Purchase Claims Master Bextra and Celebrex Complaints, saying plaintiffs' state law claims are preempted and the complaints fail to adequately allege injury. In Re: Bextra and Celebrex Marketing Sales Practices and Product Liability Litigation, MDL No. 1699 (N.D. Calif.).
On May 29, Pfizer Inc., Pharmacia Corp. and G.D. Searle & Co. filed replies in the U.S. District Court for the Northern District of California in support of their April 5 motions to dismiss the Master Complaints with prejudice.
