Merck Seeks Sanctions for Plaintiffs' Failure to Timely File Fact Sheets

LOS ANGELES - Merck & Co. Inc. is arguing that plaintiffs in California's coordinated Vioxx proceedings who failed to submit fact sheets by the court-ordered deadline should not be allowed to request relief from dismissal. Vioxx® Cases, JCCP No. 4247 (Calif. Super. Ct., Los Angeles Cty.).

Most recently, Merck filed an April 28 opposition to plaintiffs Robert and Janet Flores' motion for relief, saying the Floreses did not fulfill their discovery obligations by repeatedly missing filing deadlines established by the Los Angeles County Superior Court.
