Merck Moves for Summary Judgment in Texas Vioxx Lawsuit

RIO GRANDE CITY, Texas - Merck has moved for summary judgment in a Vioxx product liability lawsuit that is scheduled to begin jury selection on Jan. 24 in Texas. Garza, et al. v. Evans, et al., No. DC-03-84 (Texas 229th Jud. Dist. Ct., Starr Cty.).
The motion, filed in the 229th Judicial District Court for Starr County, contends that the family of Leonel Garza Sr. have proffered no admissible, scientifically-reliable evidence that Garza's seven-day use of Vioxx three weeks prior to his death could have caused, or did cause, his fatal heart attack on April 21, 2001.
