NEW ORLEANS - Plaintiffs in the Vioxx MDL have moved for certification of a national personal injury and wrongful death class that would be subject to New Jersey law. In re: Vioxx Products Liability Litigation, MDL Docket No. 1657 (E.D. La.).
In a motion filed Dec. 8 in the U.S. District Court for the Eastern District of Louisiana, the Plaintiffs' Steering Committee said that plaintiffs' claims are manageable and appropriate for class treatment, and that a trial of the litigation applying unitary law would achieve the 'greater purpose' of the MDL.
