Court Refuses to Reconsider Decision Dismissing Bextra Case

PHILADELPHIA - A federal judge in Philadelphia has rejected an attempt by plaintiffs in a Bextra suit to reconsider a ruling that dismissed the case as barred by a Michigan law that prohibits products liability claims against pharmaceutical companies. Henderson v. Merck & Co. Inc., No. 04-5987 (E.D. Pa.).

Judge Legrome D. Davis of the U.S. District Court for the Eastern District of Pennsylvania denied the motion for reconsideration on Oct. 31, rejecting Mary Henderson's contention that the court erred when it dismissed her Bextra injury lawsuit nearly three weeks earlier.
