Judge Remands Celebrex Stroke Case, Allows Joinder of Sales Representative

MONTGOMERY, Ala. - A federal judge has sent a Celebrex case back to state court after the plaintiff argued that she had pled sufficient claims against a non-diverse pharmaceutical sales representative named as a defendant in the case. Ware v. G.D. Searle, et al., No. 05-0659 (M.D. Ala.).
Judge Myron H. Thompson of the U.S. District Court for the Middle District of Alabama issued an order on Aug. 26, remanding the case to Barbour County District Court. Plaintiff Rosie Ware initially filed the case in Barbour County alleging that she suffered a stroke as a result of ingesting Celebrex.
